The fact of the matter is that many A/E firms violate federal copyright laws every day. And, while something as seemingly harmless as an interoffice publication may not result in a lawsuit, it raises the possibility that other aspects of your firm, such as a web site, may be in violation. Knowledge of U.S. copyright law is important in the marketing function of the A/E industry, as photographic images and architectural drawings that do not belong to the firm are used on a daily basis. These photographs and drawings are protected by the United States Copyright Act, which gives the owner of the copyright exclusive right to use and copy their works. Brad Klepper Attorney McAfee & Taft
Brad Klepper is a licensed architect whose legal practice focuses on construction law and intellectual property-related matters. Prior to embarking on a law career, Brad worked at the national architecture firm of Rees Associates, Inc. During this time, a large portion of his practice focused on providing construction administration services on various types of projects, specifically those in the field of education (both primary and secondary), healthcare, broadcast, and correctional facilities. By working on projects ranging in size from $250,000 to $40 million, he was able to gain valuable insight and experience in the construction industry. After discovering an industry need for attorneys who clearly understand the ins and outs of the architectural and construction businesses, Brad decided to pursue a career in law. Today, he applies his experience and expertise in both fields to representing clients on a variety of construction and development-related projects and intellectual property matters. He also serves as general counsel for the Oklahoma Board of Licensed Architects, Landscape Architects, and Interior Designers. Brad also provides pro bono legal and architectural counsel to the Oklahoma City chapter of Rebuilding Together, of which he is the president and member of the board of directors, and renders pro bono architectural consulting services to a variety of residential, commercial and nonprofit projects in Oklahoma. Brad has written and spoken on a variety of topics, including an article on copyright infringement for The Regulator, the newsletter for the Oklahoma Board of Architects; an article on toxic mold litigation for Town Talk Magazine, the publication of the Oklahoma Municipal Contractors Association; and a presentation on copyright issues to the Society for Marketing Professional Services.
Michelle Jameson Marketing Director Elliott + Associates Architects Since joining Elliott + Associates Architects in 2000, Michelle Jameson has directed the firm’s marketing efforts, including planning, research, business development, proposal and presentation strategies, and company promotional activities. Michelle has been in marketing and business development for 18 years, working for United Parcel Service prior to Elliott + Associates. At E + A, Michelle directs the public relations campaigns for the company, which includes clients such as Chesapeake Energy Corporation, BMI Systems and Downtown OKC, Inc. Her professional and civic activities include serving as a founding member of the Oklahoma Chapter of the Society for Marketing Professional Services (SMPS), chapter treasurer, and past winner of the Oklahoma Chapter’s “Pinnacle” award.
